Terms for the B⁴ App
As of October 2026.
1. Provider and scope
The provider of the B⁴ App and the site b4neuroperformance.com is Privatpraxis/-institut Dr. KAF, PD Dr. med. habil. G. Ama K. Finjap, Europastr. 4, 67433 Neustadt an der Weinstraße, Germany. Through the app we provide registered users with guided training programmes, knowledge content and support by our team.
2. Health requirements
Use of the app requires stable general health. The app does not diagnose and does not replace medical examination or treatment. Anyone in medical or therapeutic treatment should speak with us or with their treating doctor before they begin. If pain or discomfort occurs during or after training, training must stop and medical advice should be obtained where needed.
3. Services
The app provides a personal training plan, guided exercise videos, feedback and progress functions, knowledge content, chat with our team and appointment booking. The training plan is created after a personal or virtual consultation and is adjusted based on user feedback. We may continue developing the app and may add, replace or remove functions as long as the agreed core service remains.
4. Registration and contract formation
Use requires registration and a membership or another form of authorisation, for example through an employer or cost coverage. A valid email address and truthful information are required. Registration on behalf of third parties and multiple accounts are not permitted. The contract comes into effect once we confirm registration and activate access. Use is permitted from the age of 18.
5. Membership, term and end
Membership runs for 3, 6 or 12 months from activation. Costs are invoiced separately to the user or to the paying organisation. Membership ends automatically at the end of the agreed term. No cancellation is required and there is no automatic renewal. An extension must be agreed expressly and the training plan is then adjusted again.
6. User duties
Users must keep access data secure, provide truthful information, use the app only within their own account and follow the medical notice and all training instructions. The app may be used only in the permitted way and not for abusive, unlawful or technically disruptive purposes.
7. Rights of use
We grant a non-transferable, non-exclusive right to use the app and its contents during the agreed term for private use in line with these Terms. Videos, texts and training materials may not be copied, passed on, sold, made publicly available or used outside the agreed purpose without our written consent.
8. Availability and maintenance
We aim to keep the app available but cannot guarantee uninterrupted access at all times. Maintenance, technical updates, security measures, overload and events beyond our control may temporarily limit access.
9. Fees and payment
Any agreed fees are invoiced separately by the institute or by the paying organisation. Access can depend on payment, employer approval or another agreed authorisation. Team licences and cost coverage solutions are possible.
10. Liability
We are fully liable for intent, gross negligence, injury to life, body or health and under mandatory statutory product-liability rules. In cases of slight negligence, we are liable only for the breach of essential contractual duties and limited to foreseeable damage typical of the contract.
11. Data protection and confidentiality
Information about the processing of personal data is set out in the privacy policy. Health-related information is processed only where required for the service and based on an appropriate legal basis. Staff with access are bound by medical confidentiality.
12. Blocking and extraordinary termination
We may block access or terminate the contract for good cause, especially in cases of misuse, false information, security risks or serious breach of these Terms. Statutory rights of both parties remain unaffected.
13. Changes to the service
We may reasonably adjust the service, content and technical setup where this is necessary for security, legal compliance, technical development or a better user experience, provided the core contractual service is preserved.
14. Changes to these Terms
We may amend these Terms with effect for the future provided this does not unreasonably disadvantage the user. We notify changes by email. If the user does not object within two weeks, the change is deemed accepted. If the user objects, the previous Terms continue to apply and either party may end the contract at the end of the current membership.
15. Governing law and jurisdiction
German law applies. For consumers, this applies only insofar as it does not remove mandatory protections of the country of residence. If the user is a merchant, a public-law entity or has no general place of jurisdiction in Germany, Neustadt an der Weinstraße is the place of jurisdiction.
